Hedge dispute help at hand
HOME owners in Milngavie and Bearsden who are unhappy about the height of a neighbour’s hedge are set to benefit from new Scottish legislation.
The High Hedges (Scotland) Bill, introduced last October, gives the council more powers to remedy any disputes and prevent future re-occurrence of problems for residents who feel that a hedge blocks sunlight from their garden or prevents them from seeing a view from their home.
A high hedge is classed as ‘one which is formed wholly or mainly by a row of two or more evergreens or semi-evergreen trees or shrubs, rises to a height of more than two metres above ground level and forms a barrier to light’.
An owner or occupier of a house which is affected by a hedge which fits this description can apply to the council for a High Hedge Notice which can be served to the owner of the hedge which asks them to carry out the work which is required to solve the problem and if they fail to do so the council can carry out the work.
